Terms of Service

1. Service Description & Eligibility

hedg3 (“we,” “us,” or “the Service”) is a portfolio intelligence platform that provides allocation insights, market context, ranked recommendations, and alert notifications tied to your investment portfolio. hedg3 is operated by Hedg3 AI Inc.

By creating an account or using the Service you agree to these Terms. You must be at least 18 years of age to use hedg3. By accessing the Service you represent and warrant that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update that information as necessary.

2. Subscription & Billing

hedg3 offers the following plans:

• Flow — $43 per month, billed monthly.
• Apex — $297 per month, or $2,497 per year billed annually.
• Standalone trackers — individual tracker subscriptions billed monthly at the price shown on each tracker's page.

All paid subscriptions are processed through Stripe. By subscribing to a paid plan you authorize us to charge the applicable fees to your selected payment method on a recurring basis until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with our refund policy.

We reserve the right to change pricing with at least 30 days' written notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Scrape, crawl, or use automated means to access the Service beyond the APIs we provide.
• Interfere with or disrupt the integrity or performance of the Service.
• Share your account credentials or allow others to access your account.
• Redistribute, resell, or sublicense any data or content obtained from the Service.
• Use any content, charts, or data from the Service for commercial purposes without a separate written license.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

4. Intellectual Property

All content, design, code, algorithms, trademarks, and other intellectual property associated with hedg3 are owned by Hedg3 Inc or its licensors. These Terms do not grant you any right, title, or interest in our intellectual property except for the limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of any data you provide to the Service, including portfolio information. By using the Service you grant us a limited license to process your data solely to deliver and improve the Service.

5. Third-Party Services

hedg3 integrates with third-party services to deliver its features. By using the Service you acknowledge and agree to the following:

• Market Data Providers. Market data, earnings calendars, analyst ratings, insider activity, and economic indicators are sourced from third-party providers. This data is provided on an “as-is” basis and may be delayed or incomplete.
• Stripe. Payment processing is handled by Stripe, Inc. Your payment information is transmitted directly to Stripe and is subject to Stripe's terms of service.

6. Disclaimers & Limitation of Liability

All recommendations, scores, signals, and insights provided by hedg3 are for informational and educational purposes only. They should not be construed as a recommendation to buy, sell, or hold any security. You are solely responsible for your own investment decisions. Always consult a qualified financial professional before making investment decisions.

Investing involves risk, including the possible loss of principal. Past performance does not guarantee future results, and simulated or hypothetical results have inherent limitations and do not represent actual trading. Information displayed on hedg3 may contain errors or be incomplete.

6.1 Published Plays & Track Record

hedg3 publishes market ideas — including automated desk picks, surfaced plays, and screened opportunities — and records how each one subsequently performed. Those records, wherever they appear in the Service, are hypothetical results and not executed trades. hedg3 places no orders, holds no positions, takes no custody of funds, and has no knowledge of whether you acted on any idea. No capital of ours was ever at risk in producing them, and they do not represent the actual trading of any account.

Recorded outcomes are measured from quoted market prices — the mark at which an idea was published and the mark at which it was settled — and do not deduct commissions, fees, financing costs, or slippage. A real position would incur those costs, and the price at which you could actually transact may differ from the quoted mark. Fills are not guaranteed at any displayed price. Hypothetical results also benefit from hindsight in ways live trading does not, and have other inherent limitations. Past performance is not indicative of future results.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the fullest extent permitted by law, Hedg3 AI Inc and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment losses, arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

7. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Service at our sole discretion, with or without cause, and with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) shall survive.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
